What Our Clients Say

What is Estate Planning in
Fountain Inn, SC?

The word "estate" might make you think of a sprawling mansion in the French countryside. The truth is, you don't have to be rich to have an estate. In fact, most people already have an estate. An estate comprises the assets that a person owns like cars, bank accounts, real estate, businesses, and other possessions. Everyone's estate is different, but we all have one thing in common: none of us can take our estates with us when we die. When that does eventually happen, you will need legal instructions that state who gets what from your estate in plain terms. That, in a nutshell, is estate planning building a framework in advance that names the organizations or people that should receive your assets after you die. Planning your estate now helps make life much easier for your family down the line.

Estate Planning Lawyer Fountain Inn, SC
A good estate plan covers more than fiscal assets, however. A comprehensive
estate plan should include the following:
  • If you have children who are minors, instructions as to who will be their guardian when you die.
  • Long-term care insurance if you suffer from an extended injury or illness.
  • Instructions that dictate what happens to you and your financial affairs if you become incapacitated before death.
  • Instructions on the transfer of your business after retirement, incapacity, disability, or death.
  • Instructions on how to provide for loved ones who might need help managing money or who need protection from creditors.
  • Probate and tax avoidance that help minimize court fees, taxes, and legal fees.
  • Planning Medicaid payments.
  • Instructions that help complete or update beneficiary designations.
  • Assist family members who have special needs without disqualifying them from government benefits.

Contrary to popular belief, estate planning isn't just for adults who are approaching retirement age. Estate planning is for everyone. After all, we're all getting older, and none of us know exactly when it will be our time to go.

The Basics of Estate Planning
in Fountain Inn, SC

Although estate planning can be complicated, a well-rounded plan makes a huge difference in what is left to your beneficiaries. Before you start planning your estate, it's important to know a few common topics that may arise as you detail your needs.

1.

Working with a Tax Advisor and Estate Planning
Attorney in Fountain Inn, SC

Working with a veteran estate planning lawyer is a no-brainer, but you should consider working with a tax advisor too. Your attorney's role is to help guide you through the creation of your estate planning documents. Common documents include your will, health care directives, and power of attorney. Your tax advisor will help guide you through tax issues associated with your estate planning needs.

In this relationship, you make the decisions while your attorney and tax advisor help you understand and think through the options you're considering. As a team, they will help you state your wishes clearly while minimizing mistakes and adjusting your plans as they change. Because significant savings can result from thorough, informed planning, you should seriously consider working with a tax advisor in addition to your estate planning attorney.

2.

Maximizing
Your Estate

If there were one overriding theme of estate planning, it would be maximizing what you plan to leave behind. Thinking through how each of your assets will be distributed is crucial to your estate. Your decisions may change depending on the type of asset, its size, how old you are, and several other factors. With an attorney on your side, you will gain a thorough understanding of what actions you should take to care for your family while minimizing expenses like taxes and court fees.

Estate Planning Law Fountain Inn, SC
3.

Inheritance, Estate,
and Gift Taxes

One of the biggest parts of maximizing what you're leaving behind is to minimize taxes. Federal taxes on estates and gifts are incredibly high. Both forms of taxes usually have exemption limits, which means you can give up to a specific amount without being taxed. Your lawyer can achieve that by using the gift tax exemption to move assets while you are still alive. This strategy maximizes how much your beneficiaries will receive.

Inheritance taxes are often based on the value of your estate and paid prior to asset distribution to your beneficiaries.

Choosing the
Executor of Your Will

The executor of your estate plays a key role in your affairs. Their responsibilities include carrying out the terms of your will and seeing the estate settlement process through until the end. Obviously, such a role demands a qualified person. Choosing your executor isn't an easy decision. The person you select should be great at managing money, be savvy financially, and show an ability to be patient. That's because the executor is tasked with:

  • Collecting Your Assets
  • Paying Outstanding Bills
  • Submitting Tax Returns
  • Petitioning the Court for Documents
  • Distributing Assets to Your Beneficiaries
Estate Planning Lawyer Fountain Inn, SC

If the person that you choose as executor is inexperienced with the estate settlement process, it is recommended that they lean on an estate planning attorney in Fountain Inn, SC for guidance. It should be noted that you may appoint more than a single executor to your estate. This is common when two individuals have complementary personalities or skill sets.

The Benefits of Estate Planning
in Fountain Inn, SC

One of the biggest benefits of planning your estate is the peace of mind it brings to you and your family. With the help of our expert estate planning attorneys, you have the power to protect your assets, privacy, and children's welfare. You can also potentially save money on taxes or even avoid probate. By having your wishes legally documented before death or incapacity, you can minimize any impact on your beneficiaries and take control of your legacy. Without a comprehensive estate plan, you're leaving the future of your loved ones in the hands of the South Carolina court system.

With an estate plan in place, you can plan for incapacity by using a power of attorney or advanced medical directives. Doing so relieves your loved ones of the burden of asking the court for the authority to fulfill your wishes.

At CDH Law Firm, we are committed to helping you prepare for both the expected and unexpected through years of experience and a fierce dedication to our clients. From establishing trusts to designing business succession plans, we are here to fight for you.

At CDH we offer a "Will Package" that includes 4 necessary documents.

If a husband and wife each purchase reciprocating will packages we give a discount. Reciprocating just means the husband names the wife and the wife names the husband. Those four documents are:

  • Last will and testament
  • Healthcare power of attorney
  • Durable power of attorney
  • living will

Common Documents Included
in Your Estate Plan

As mentioned above, everyone's estate planning needs will be different. However, most plans include one or more of the following documents:

1.

Will

Your will is an essential piece of documentation and is often considered the cornerstone of a proper estate plan. Generally speaking, your will is a document that dictates the distribution of your assets after your death. Having an iron-clad will is one of the best ways to make sure that your wishes are communicated clearly. As is the case with most estate planning, it is highly recommended that you work with an estate planning attorney in Fountain Inn, SC, to create and update your will.

The contents of a will typically include:

  • Designation of the executor, who is responsible for adhering to the provisions of your will.
  • Designation of beneficiaries the people who will be inheriting your assets
  • Instructions that dictate how and when your beneficiaries will receive assets.
  • Instructions that assign guardianship for any minor children.

Without a will in place, the State of South Carolina will decide how to distribute assets to your beneficiaries. Allowing the state to distribute your assets is often an unfavorable route to take, since the settlement process may not include what you had in mind for your survivors. Having a will drafted that reflects your wishes will prevent such a situation from happening.

2.

Living Will

Despite its name, a living will does not instruct your survivors on what assets go where. Also called an advanced directive, your living will allows you to state your end-of-life medical wishes if you have become unable to communicate. This important document provides guidance to family members and doctors and solidifies certain issues like whether you should be resuscitated after an accident.

For example, it's common to direct that palliative care (care to decrease pain and suffering) always be administered if needed. Conversely, you may state that certain measures are not allowed, like CPR.

Estate Planning Law Fountain Inn, SC
3.

Trusts

Traditionally, a trust is used to minimize estate taxes and maximize other benefits as part of a well-rounded estate plan. This fiduciary agreement lets a trustee hold your assets on behalf of your beneficiaries. There are many ways to arrange a trust to specify when and how your assets are distributed.

With a trust in place, your beneficiaries can avoid going to probate. That means they may be able to gain access to your assets quicker than when they are transferred with a standard will. Assets placed in a trust can pass outside of probate, which will save you and your family time, money, and stress.

There are two distinct trust categories that you should be aware of: revocable and irrevocable.

Estate Planning Attorney Fountain Inn, SC

Revocable Trust:

Also called a living trust, a revocable trust helps assets circumvent probate. With this trust, you can control your assets while you are still alive. These trusts are flexible and may be dissolved at any point in time. This type of trust becomes irrevocable upon your death. Revocable trusts can help you avoid the pitfalls of probate but be aware that they are usually still taxable.

Irrevocable Trust:

This kind of trust transfers assets out of your estate so that they are not taxed and do not have to go through probate. However, once an irrevocable trust has been executed, it may not be altered. That means that once you establish this kind of trust, you lose control of its assets and cannot dissolve the trust. If your primary goal is to avoid taxes on your estate, setting up an irrevocable could be a wise choice.

When drafted with the help of an estate planning lawyer in Fountain Inn, SC, your trust can also:

Protect Your Legacy:

When constructed properly, a trust can protect your estate from your heirs' creditors. This can be a huge relief for beneficiaries who might need to brush up on money management skills.

Privacy and Probate:

Probate records are made available for public consumption. With a trust, you may have the choice of having your assets pass outside of probate court so that they remain private. In the process, you may also save money that you would lose to taxes and court fees.

Control Wealth:

Because you can specify the exact terms of a trust, you have more control over who receives your assets and when they receive them. As an example, you can set up a revocable trust so that your assets are attainable while you're alive. When you pass, remaining assets are distributed, even in complex situations involving children from multiple marriages.

GREENVILLE COUNTY, S.C. —

The Greenville County School Board of Trustees has approved additional funding and a land purchase for expansions for two schools in Fountain Inn.

First, board members approved adding $16.9 million to the cost of an addition to Fountain Inn High School. The project now has a total cost of $48.4 million.

Scott Carlin, executive director of facilities, said it will add more classrooms and a fine arts space to handle 250 more students than planned.

"The original school was built for 1,000 students with the expectation to go to 2,000," Carlin said. "We thought that it wasn't going to be needed as soon as it is, but of course, as we all know, the county is growing and certainly in that part of the county."

Fountain Inn officials said they have grown by 34% since 2010, which is double Greenville County's growth in the same time span.

The median age for the city has also dropped by four years to just over 32, and more than 4,000 people have moved to the city since 2000.

Parents like Kevin Autauvo said the project to expand the high school is needed.

"It being a new school and there hasn't been a senior class yet, and next year there will be a senior class — with all the new freshmen coming in from Rudolph Gordon from the eighth-grade class coming in as ninth graders, I think it's really important," he said.

Trustees also approved buying over three-quarters of an acre for a future expansion of Fountain Inn Elementary School.

School officials plan to turn the campus into a K-8 school.

"We need that extra land to be able to add on to the back of the school to have enough room for the additions as well as some other requirements," Carlin said.

Carlin added staying ahead of future growth is one of the district's biggest priorities.

"We want to make sure that we're getting slightly ahead of growth, so we're not having to do — as you've seen in other school districts in the state where you have portable farms — portable classroom farms all over the place. We don't want to get to that place," Carlin said.

Carlin said the addition to the high school should be completed next August, but they will have a modular classroom building on campus until that's ready.

The expansion for the elementary school, meanwhile, will likely not be done until 2030, according to Carlin.

Tesla will open a regional distribution center in Fountain Inn in Greenville County, S.C. in early 2024, another promising development in support of the booming automotive and EV economy of the Upstate and South Carolina.

The center is believed to mark Tesla’s first major investment in operations in South Carolina.

The inaugural Tesla facility in the Palmetto State will be located in Fox Hill Business Park -- the Class A business and industrial park which came online in 2020 as the first major business park developed in Greenville County in well over a decade.

Fox Hill Business Park, located on 172 acres in the City of Fountain Inn, is being developed by The Sudler Companies, a family- and veteran-owned and operated development firm based in Chatham, New Jersey.

The Tesla facility in Greenville County will mark the second such venture between Tesla and The Sudler Companies in 2023, the duo having announced a similar project near Tampa, Florida, in 2023.

“Tesla’s commitment to Fox Hill Business Park in Greenville County is a testament to the continued strength of our company’s partnership with Tesla and to the indisputable drivers that make the park and the Upstate a force in the logistics world,” said Brian Sudler, principal with The Sudler Companies.

Tesla’s work in Greenville County will focus strictly on distribution of vehicle parts regionally and won’t include manufacturing, officials said.

Tesla will absorb all of Fox Hill’s Building 3, comprised of 251,100 square feet. Depending on final development strategies, the Fox Hill Business Park campus can accommodate up to 2.5 million square feet of manufacturing, distribution, and warehousing activity across multiple buildings.

Total investment and planned job additions by Tesla haven’t been made public.

Late in 2023, Tesla posted a hiring notice for a training leader to support and train employees at the new facility in Greenville County.

A company focused on accelerating the world’s transition to sustainable energy, Tesla is committed to building a world powered by solar energy, running on batteries, and transported by electric vehicles that charge with clean energy.

Tesla operates six vertically integrated factories across three continents and employs over 100,000 employees who design, build, sell and service Tesla products in-house.

The Tesla announcement is the latest major announcement for Fox Hill, which also saw the recent addition of Sage Parts Plus, a global leader in replacement parts for aviation ground support equipment.

Sage Parts opened new distribution operations in Fox Hill Business Park in mid-2023, leasing a 103,049-square-foot building to accommodate distribution operations along with its new global headquarters that houses its leadership team, purchasing, finance, customer service, HR, product management, and other support departments.

Fox Hill Business Park has immediate access to Interstate 385, I-85, the Inland Port in Greer, South Carolina, and Greenville Spartanburg International Airport.

The Sudler Companies are a vertically integrated development firm that includes construction and property management departments and owns and manages over 12 million square feet of commercial real estate across America.

“The addition of the Tesla brand to Greenville’s business ecosystem is another example of the important role that speculative development plays in today’s competitive environment, and exactly why Greenville County was so supportive of The Sudler Companies and Fox Hill Business Park,” said Kevin Landmesser, interim CEO of the Greenville Area Development Corporation.

“We are excited that Tesla has chosen to call Fountain Inn home for their first facility in South Carolina,” said City of Fountain Inn Mayor GP McLeer. “This facility will not only create local jobs that will support families, but it also helps many of our region's existing suppliers get their products to one of the nation's most innovative automotive companies more efficiently.

McLeer added, "We continue to be proud of our community's expanding role in the automotive industry and are excited to see Tesla begin operations.”

Since its founding in mid-2001, the GADC team’s efforts have resulted in the announcement of more than 34,600 new jobs and more than $6.6 billion in capital investment in Greenville County.

FOUNTAIN INN — Three buildings on the edge of Fountain Inn's downtown have long stood unused, further deteriorating with the passage of each year.

In 2021, developer Bryan Beal bought them with plans to transform the fallow tract at the intersection of Wall and Ellison streets into an entertainment campus, complete with a brewery, food hall and outdoor event space.

That vision is now coming into sharper focus every day as work continues on the three historic buildings.

The brewery, a secondary gathering space and an open green space are set to open this spring, while the food hall will likely be up and running by late summer or early fall.

Construction crews broke ground on the renovations in February 2023, and the site has transformed in the year since.

Each of the buildings standing on the site — a former flour mill and two nearby structures — will each serve a separate function.

The three-story mill, originally built in the early 1940s, will be a full-service brewery with some food offerings, including pizza. The first floor will have a 15-tap bar, while the second floor will function as a coworking space during the day and a secondary bar and event space in the evening. The third floor will not be open to the public, though Beal said he hasn't ruled out updating it in the future to make it fit for commercial use.

While the structure is undergoing a major renovation, Beal is striving to preserve as much of the structure as possible. Much of what he couldn't repurpose will remain intact as aesthetic nods to the mills past. That includes a staircase and elevator shaft on the second floor that have been encased in glass for display.

Last week, most of the equipment needed to brew beer at the facility was installed on the basement level.

Beal said the next building over, which sits in the center of the .75-acre property, will be part history museum, part gathering space. Disused milling equipment found in the mill buildings will be put on display, and the building will include additional seating. Bay doors in the back will open onto a porch overlooking the open green space, which will connect all three buildings.

The planned size of that outdoor space has roughly tripled with the acquisition of another nearby property. It will include a 21-by-12-foot screen for sporting events.

Greenville News

In addition to expanding the green space, the purchase of the abutting property will allow for the addition of a parking lot, and Fountain Inn is adding a city lot nearby.

The third building, which stands in the northwest corner of the property, is set to open several months after the rest of the project. It will include a food hall featuring local vendors as well a full bar with taps offering beer from the nearby brewery. It will also include an "entertainment component" with games, though the specifics have not been finalized.

Greenville Business

Fountain Inn City Administrator Shawn Bell, who first helped Beal identify the property as a development opportunity, said the project will be a significant contribution to the city's downtown.

"I don't think there is anything around that is like this," he said. "I think there are going to be people that will want to travel from all over to experience what the flour mill has to offer."
